Welcome to Daily99. These Terms and Conditions ("Terms") govern your use of the Daily99 mobile application, website, and all related services (collectively, the "Platform"), operated by ("we," "us," or "our").

By creating an account or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.

1. Eligibility and Account Registration

1.1. Age Requirement: You must be at least 18 years of age and capable of entering into a legally binding contract to use the Platform.

1.2. Account Creation: You may create an account using a valid mobile number (verified by a one-time password) or through supported social login providers (e.g., Google, Apple).

1.3. Unified Identity: To ensure a seamless and secure experience, your verified mobile number will serve as the unique anchor for your account. If you sign in with different social providers, you will be prompted to verify your mobile number to link them to your single, unified Daily99 profile. This prevents the creation of duplicate accounts and ensures all your virtual assets and order history are consolidated.

1.4. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. The Daily99 Platform: E-Commerce & Entertainment

Daily99 is a "Retail-tainment" platform that combines e-commerce with a daily skill-based contest.

2.1. E-Commerce Transactions:

  • All products available on the Platform are offered for a fixed price of ₹99.
  • All commercial terms, including price, shipping costs, and warranties, are offered by and agreed to between you and the third-party sellers on the Platform.
  • Payments are processed through our trusted third-party payment gateway, Razorpay. We do not store your sensitive payment card information on our servers.
  • Please refer to our Shipping & Delivery and Returns Policy pages for detailed information. Returns are accepted only for products that are damaged or defective upon arrival.

2.2. The 9:22 PM Daily Draw (Game of Skill):

  • Each purchase of a product for ₹99 on the Platform grants you one (1) entry into the daily draw event held at 9:22 PM IST (the "Daily Draw").
  • The Daily Draw is a game of skill, where the outcome is predominantly determined by a user's skill, knowledge, and judgment, not by chance. This is in accordance with Indian law, which distinguishes games of skill from gambling.
  • The specific mechanics of the skill-based challenge will be detailed within the "Draw" section of the Platform. By participating, you acknowledge and agree that the element of skill is the predominant factor in determining the winner.
  • The selection of winners is conducted through a transparent and auditable process to ensure fairness, a core principle of our brand.

2.3. Gamification & Virtual Economy:

  • XCoins (XC): The Platform features a virtual currency called "XCoins." XCoins are not real money and have no monetary value. They are earned by completing in-app actions such as Daily Heists, daily check-ins, and participating in spin-the-wheel games.
  • The Black Market: XCoins can be spent exclusively in the "Black Market" to acquire virtual goods for in-app use, such as masks and backgrounds for your agent profile. These virtual goods are for entertainment purposes only and cannot be traded or redeemed for cash.
  • Spins & Rewards: The Platform includes reward mechanics like the "Daily Lucky Spin" and the "Consolation Spin" for non-winners of the Daily Draw. The prizes, and rules for these games are displayed within the app.

3. User Conduct and Prohibited Activities

You agree not to use the Platform to:

  • Violate any applicable laws or regulations.
  • Engage in any fraudulent activity, including the use of stolen payment methods.
  • Harass, abuse, or harm another person, including in the "Green Room" live chat.
  • Post or transmit any content that is obscene, defamatory, or infringing on any third party's intellectual property rights.
  • Attempt to interfere with the proper working of the Platform, including by using bots, hacking, or transmitting any malicious code.
  • Create multiple accounts for a single individual to abuse promotions or the gamification system.

We reserve the right to terminate or suspend any account found to be in violation of these rules at our sole discretion.

4. Intellectual Property

All content on the Platform, including the Daily99 name, logo, character art (Rahunox and Meecurya), graphics, text, and software, is the exclusive property of or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, or distribute any of our content without our express written permission.

5. User-Generated Content

The Platform may allow you to submit content, such as messages in the "Green Room" live chat. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Platform. You are solely responsible for the content you submit and agree not to post anything that violates these Terms. We reserve the right to monitor and remove any user-generated content at our discretion.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information are governed by our Privacy Policy. We are committed to complying with all applicable data protection laws, including India's Digital Personal Data Protection Act, 2023 (DPDP Act).

7. Disclaimers and Limitation of Liability

7.1. As-Is Basis: The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

7.2. Limitation of Liability: To the fullest extent permitted by law, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Platform.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on the Platform or by sending you an email. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms. 9
